Terms of Service

These Terms of Service ("Terms") govern your use of the Formal Tradie platform at www.formaltradie.com (the "Platform"), operated by Formal Tradie Limited, a New Zealand registered company ("Formal Tradie", "we", "us", "our").

By creating an account or using the Platform, you agree to these Terms. If you don't agree, don't use the Platform.

1. Who can use Formal Tradie

You must be at least 18 years old and able to enter a legally binding contract. If you use the Platform on behalf of a business, you confirm you have authority to bind that business to these Terms.

2. Your account

You're responsible for keeping your login details secure and for everything that happens under your account. Tell us immediately if you suspect unauthorised access.

3. Free trial and subscription

  • We offer a 14-day free trial.
  • After the trial, the Pro plan is $12.95 per week (charged in NZD or AUD as applicable), unless you cancel before the trial ends.
  • Payments are processed by our third-party payment processor. By subscribing, you authorise recurring charges until you cancel.
  • Prices may change. We'll give you reasonable notice before any price change affecting you.

4. Partner offers

  • We may make discounts, trials or other offers available through participating partner organisations.
  • Each partner offer is subject to the eligibility requirements, pricing, duration and conditions displayed on the relevant offer page or checkout.
  • By claiming a partner offer, you confirm that the eligibility information you provide is complete and truthful.
  • Partner offers are personal and non-transferable unless expressly stated otherwise.
  • Partner offers cannot be combined with another discount or promotion unless expressly allowed.
  • A Formal Tradie Pro free trial is generally available only once per eligible customer.
  • We may request reasonable evidence of eligibility where misuse is suspected.
  • We may withhold, remove or correct an offer where the eligibility declaration is false, misleading or does not meet the stated conditions.
  • The duration of a discount is determined by the conditions displayed for that particular partner offer.
  • Eligibility may need to be reconfirmed if a discounted Formal Tradie subscription is cancelled and you later attempt to resubscribe.
  • Changes to a partner relationship will not remove rights or benefits already contractually confirmed to you, except where you breached the offer conditions or where the applicable terms permit the change.

5. Cancellation and refunds

  • You can cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period.
  • Except where required by law (including the Consumer Guarantees Act 1993 in NZ and the Australian Consumer Law), fees already paid are non-refundable.

6. What you can and can't do

You agree not to:

  • Use the Platform for any unlawful purpose;
  • Upload content you don't have the right to use;
  • Attempt to access, interfere with, or disrupt the Platform or its security;
  • Copy, resell, or reverse-engineer the Platform;
  • Use the Platform in a way that harms us or other users.

We may suspend or terminate your account if you breach these Terms.

7. Your data and content

You own the data and content you put into the Platform. You grant us a licence to use it only as needed to provide the Platform to you. How we handle your personal information is set out in our Privacy Policy.

8. The Platform is a tool, not professional advice

Formal Tradie is a project budget tracking and client reporting tool. It does not provide financial, accounting, tax, legal, or other professional advice. Any figures, reports, or outputs are based on the information you enter, and you are responsible for verifying them and for the decisions you make. You should seek professional advice where appropriate.

9. AI Assistant

The Platform includes an AI-powered assistant that provides general information in response to your queries. Its responses may not always be accurate or complete, and should not be relied on as professional advice. You remain responsible for checking any information before acting on it.

10. Availability

We aim to keep the Platform available and reliable, but we don't guarantee it will be uninterrupted or error-free. We may carry out maintenance, updates, or changes, and may modify or discontinue features.

11. Our liability

To the maximum extent permitted by law:

  • The Platform is provided "as is";
  • We are not liable for any indirect, incidental, or consequential loss, or for loss of profits, data, or business arising from your use of the Platform;
  • Our total liability to you in any 12-month period is limited to the amount you paid us in that period.

Nothing in these Terms limits rights you have under the Consumer Guarantees Act 1993 (NZ) or the Australian Consumer Law that cannot lawfully be excluded.

12. Intellectual property

The Platform, including its design, software, branding, and content (excluding your data), is owned by Formal Tradie Limited and protected by intellectual property laws. You may not use our branding or content without our written permission.

13. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version and update the "Last updated" date. Continued use after changes means you accept them.

14. Governing law

These Terms are governed by the laws of New Zealand. Any dispute will be dealt with by the New Zealand courts, unless mandatory consumer law in your location provides otherwise.
